After the death of the managing shareholder, THI stabilised operations on behalf of the estate administrator, negotiated a standstill agreement with the creditors and has since supported the insolvency administrator – creditors can expect nearly full satisfaction of their claims.
After the death of the managing shareholder, a mid-sized trading company found itself in an acute management crisis. Legal succession was unclear; day-to-day business, personnel matters and creditors’ interests had to be ordered at short notice.
On behalf of the estate administrator THI took over the management, secured ongoing business operations, realised stock and business equipment, reduced the workforce in a socially responsible manner and negotiated a standstill agreement with the creditors in preparation for a winding-up. When that agreement did not come about, THI filed the company’s own petition to open insolvency proceedings and has since supported the insolvency administrator in carrying them out.
The insolvency proceedings are largely concluded. The expected recovery rate comes close to full satisfaction of the creditors – broadly in line with the agreement negotiated by THI.
