A regional hospital group settles liability claims arising from hospital operations from its own provisions. THI secures the actuarially calculated funds on a fiduciary basis – in a security event the injured parties have a direct, insolvency-proof claim for payment against THI.
Background
A group of acute hospitals, specialist clinics and care facilities sets up provisions for liability claims for personal injury and property damage, the amount of which is calculated annually by a recognised actuary (DAV). These funds were to be secured against insolvency in favour of the injured parties.
THI’s role
THI holds assets in the amount of the actuarially calculated provisions in a trust account with a securities portfolio as a genuine contract for the benefit of third parties, from which the injured parties acquire a direct claim against THI in a security event. THI pays larger claims directly to the beneficiaries after examination and release, monitors the agreed coverage limits, adjusts the trust assets annually in line with the actuarial calculation and reports monthly via the sealed cloud.
Result / status
The security trust has been set up and is in ongoing operation. The trust assets amount to around EUR 25.9 million.
